不管是新移民加拿大还是来加拿大留学,都不可避免的会遇到一个问题,就是:租房。租房是大家到一个地方生活第一件要做的事情,很多人进入了陌生环境,又对当地的法律法规以及各种“租房潜规则”不懂,被经纪或者房东忽悠也是很常见的事情,被坑被骗成为很多新移民和留学生,初来加拿大的见面礼,经历过此类事件的朋友,想必偶尔想起来,还会耿耿于怀吧。
其实,租房这件事是需要谨慎的,找不好轻者破财消灾,被房东算计、支付一些非法费用,重者会被非法驱逐,这样的结果就严重了。
那么,对于初来乍到的新移民或者留学生来说,租房的时候需要了解些什么呢?有什么“防坑”招数可以推荐呢?感兴趣的可以一起了解一下!
租客这10点权利义务须知 避免房东瞎忽悠
1、租客支付房东房租或其他任何费用,都应索取收据。
2、签租房协议时,房东可能会收取保证金,法律规定,如按月付房租,保证金不得超过1个月租金。保证金只能作为最后搬出前1个月租金。
3、签署1年租房合约的,住满1年后,如合约未续签或终止,可按月支付房租继续住在原地,房东不得强迫租客续签或弃约,也不得在没有征求租客许可情况下,变更租房协议条款。
4、房东或租房合同不得要求租客支付长期租金支票,也不得强迫租房现金支付房租。
5、按照交房租,才能有效保护自身权益,不被驱逐。如遇房子维修或维护问题、鼠患或虫患等,或房东不尊重租客权益,可采取其他法律措施要求房东解决。
6、住宅租赁法(Residential Tenancies Act)严令禁止房东收取房租拖延费、客人留宿费或其他各种名目费用。
7、房东每次涨房租时,只能是在租客入住12个月后或离上次涨房租12个月后。此外,房东涨房租前,必须至少提前90天书面通知。
8、房租涨幅有2套规定:如租用的住宅为老旧建筑或出租房,房租最大涨幅政府是有限制的。但如所租住宅为新建大楼或出租单位,则不适用于上述指南,房租涨幅全看房东。
(旧楼是指1991年11月1日以前建成或首次住人的住宅建筑,新楼是指此后建成或首次住人的住宅建筑,或1998年6月17日前无人入住过的建筑。)
9、房东收取损失和清洁保证金是非法的。
10、租客冬天也有可能被驱逐。许多人误以为,房东冬天不得驱逐租客,实际上不是这么回事。
