律师楼的交易终止 (Dead Deal) 有时也会出现因为各种情况而产生的交易终止,如银行改变主意,你贷不了款;或买卖任何一方改变主意,不再继续交易;或客户临时更换律师等,这种交易终止对于律师来说叫 Dead Deal。如果律师事务所刚开客户档案,没做什么事情,一般不收客人费用,但如果已经开始做了文件或部分工作,律师事务所会将应收的部分费用转给客户新的律师代收。为了避免交额外的费用,找律师的时候尽量慎重,以免中途更换律师产生额外费用。
你去律师事务所要带的东西 (What you should bring when meeting your lawyer) 律师事务所做好文件之后,会打电话给你,约你去签文件,一般他们会要求你带: ID (身份证明,必须有你的照片如驾照等),有些律师还会要你提供多一份没有照片的身份证明,如有你名字的信用卡。 Void Cheque (作废支票,这是给银行提供你以后每月付银行贷款的帐户资料。如果是一次付清的现金交易(Cash Deal)就不必带作废支票。) Shortfall (你预付给律师事务所的钱)这笔钱包括你应付银行的首期,如果是一次付清的现金交易(Cash Deal)就不必此项、地税、如果是公寓还有公寓管理费(地税和公寓管理费如果卖方在交房日之前有未缴付的部分,卖方应该退回给你,这些律师事务所会帮你计算)、律师费以及园艺押金 (Landscaping Deposit)等项,通常这是律师事务所预估一个大约的数,将来律师文件完成后多退少补,一般相差不大。 如果预付给律师的钱Shortfall超过一千元,律师事务所一般都不收现金或私人支票, 你要去银行开张银行汇票(bank draft),银行办理手续费7元左右。如果你自己开的私人支票必须到银行去做认证(certified cheque),银行认证费10元。
你去律师事务所需要签的文件 (What you need to sign) Mortgage (律师事务所根据银行的贷款指示做出的两份贷款文件) Mortgage Approval (银行提供的贷款审批) Mortgage Commitment (银行提供的贷款承诺) Mortgage Disclosure Statement (贷款帐目公布) Life Insurance Application (银行提供的人寿保险申请,银行希望万一贷款人发生意外,他们可以从保险公司拿回钱。但这种保险不是必须要买的,客户可以自行决定是否需要购买人寿保险,如果你不想购买,就在No处签字,反之,在Yes处签字。 以上几份文件因银行而异,有些只签其中一部分。 Order and Direction to Pay (付款指令) 这是律师事务所要你签的一份文件,同意他们收到你的钱及银行的贷款前期资金后,代你支付银行的首期、地税、公寓管理费、律师费等,如果有多余的钱将如数退回给你或你指定的人。) Tenancy At Will (租赁合同 ) 一般你的律师要等所有的文件齐了,还要等收到银行的 Mortgage Advance Funds (贷款前期资金) ,在房屋转了你的名之后才会将钱转给卖方律师,如果前面三种情况任何一种未完成,卖方就不会及时收到钱,那就意味着买方有可能推迟拿钥匙。如果你一定要在 交房日那天拿钥匙,你就要签一分这样的租赁合同,即卖方同意在交房日中午12点交钥匙给买房,但买方自拿钥匙之日起需付给卖方房款的利息,直到卖方收到钱 为止。 Covenant To Restore Title & Transfer of Land (Back)如果房屋转了你的名之后,万一银行改变主意,不贷款给你,那就意味着对方将有收不到钱的风险,这两份文件都是要求你同意在这种情况下,你要无条件将房屋的产权转回给卖方。这份文件一般律师事务所都要你签,但实际发生机会很少,只是以防万一。
Power of Attoney (授权书)如果你是已婚,联名买房卖房,通常必须要两个人签字,如果其中一人到时候不能来签字,要提前签一份授权书(Power of Attorney)。
你应从律师事务所收到的文件(Final Report Package) 你的律师工作完成后,你应该收到律师事务所给你的以下文件的全部或部分,因情况不同而异: 1. Trust Cheque (律师退款支票)如果你预付律师事务所的钱有多,你会收到一张退款支票。相反,如果你预付律师事务所的钱不够,他们会通知你带现金支付你欠他们的钱,即Outstanding Balance Owing。 2. Condominium Documents (公寓文件,如果是买公寓才有) 15. Statement of Adjustment (款项调整说明书,列明房价、押金、银行贷款前期资金、地税、公寓管理费等,是卖方律师要求买方律师付的所有款项) 16. Copy of Cash to Close Letter (买方律师在交房日当天给卖房律师的转款信,如果所转款项跟卖方律师的款项调整说明书一致,这封信就不必复印给客户。只有当这两项金额有差异时,如实际付的款项多出几天的利息等,这份信才复印给客户参考。) 17. Statement of Account for Services Rendered (律师事务所服务开支明细表,会详细列明律师楼帮你做过哪些事情及没项收费) 以上文件因申请贷款的种类和银行不同,律师事务所给客户的文件也不尽相同,其中第5-9项,有些银行有,有些没有。由于部分文件是原件,所以这些文件连同支票通常是要求客户亲自去律师事务所取,如果你需要他们快递给你,他们也会收你快递费。
房屋验收 (Walk Through & Inspection) 发展商提前一个月给你发收房通知,在这期间,你可以约承建商初步验房(Walk through),他们会有专人并备好详细的验收表格陪同你一起验收,发现不满意的地方记录下来,他们会在交房日之前给你修整。如果你交房日当天还有些不 满意的地方,也不必担心,一般新房子除交房前的Walk though外,在你搬入后半年及一年的时候分别还有两次房屋检验(Inspection)。他们会给你一份表格(Request for Services),你可以把你发现的问题随时记录下来,你在入住一年内,发现任何房屋的质量问题,随时记录下来,传真给发展商,他们会再派人上门帮你检 查。半年及一年内的房屋检验也是要提前与承建商预约,检验中发现问题,他们会派不同的人来为你修整。建新房一般都有五年的新房保证,但主要是针对房屋结构 方面,不包括一些其它维修以及业主自己使用坏了的部分。如果买很久的二手房,找一个专业的验房师帮你检验一下,看房屋的结构、屋顶、水电、保暖、锅炉等是 否有问题,如果发现问题,你可以选择不要这个房子,如果你签的房屋购买合同的条件是取决于验房。如果没有这个条件,你就只能跟卖房协商谁负责维修,谁负责 出钱,出多少钱等。 预约水电、燃气、电话、电视等公司 (Utilities) 在收房日前至少提前10天左右打电话预约水电、燃气、电话、电视等公司在交房日当天来安装或抄表,最好约下午,因为一般拿钥匙都要等到交房日中午12点,所有电话号码在交房日通知书上列有。
新房钥匙和邮箱钥匙(House Key and Mail Box Key) 如果一切顺利,收房日中午12点你的经纪会去对方的律师楼帮你拿钥匙,然后送给你,但这只是房子前后门的钥匙,邮箱钥匙你需要自己去附近的邮局取。如果购 买二手房,所有钥匙都一次性给你。现在的新区不是每家门口有自己的邮箱,而在每条街区有一个集中派邮件的邮箱站,新房住户需要自己去附近的邮局取邮箱钥 匙。具体做法是交房日前一周打电话给最近的邮局,电话号码也列在交房通知书上,问清楚取邮箱钥匙的时间和地址,一般一个邮箱只给一把钥匙,如果需要,你自 己去配。
铺表土和地面平整最后合格证书(Top Soil and Final Certificate) 园艺的第一步是铺表土,就是我们经常看到的那种比较肥沃的黑土,通常打电话叫人送,连运费120 -150元一卡车,根据你前后院子的面积,一般最少都要3至4车。 铺表土是在平整过的土地上平均加高10公分,铺完还要到Home Depot 租工具回来把地面压实,然后打电话通知市政来二次检验,检查表土的厚度以及水的流向是否合乎要求。如果合格,你就可以收到地面平整最后的合格证书 (Final Certificate)。
挖坑种树前必须先打电话(Dial Before You Dig) 在前院挖坑前必须打电话给一个名为“Dial Before You Dig”的机构,爱城电话1-800-242-3447,叫专人来标记水、电、煤气管道的位置,否则不得自行乱挖。他们会在电话里跟你预约时间,并告诉你一个预约号码 (Ticket Number) ,你下次再打电话查询时需要报这个号码。一般一周内他们会派人来,当你看到家门口土地上有些红、黄线并插着红、黄色的小旗子,那就说明他们来过了。你挖的坑必须离开插旗的线一英呎远,挖好坑你就可以种数种花了,但要留意必须符合所在社区的具体要求。
